• Payment Data: Transaction records and payment method information. We do not store full credit card or crypto wallet details on our servers.
• Technical Data: IP address, browser type, device information, and usage logs collected automatically when you access our platform.

• Verifying your identity and preventing fraud through our KYC process.
• Processing number port requests and hosted SMS setup with carriers.
• Sending registration invoices, payment confirmations, and service notifications.

• Improving our platform, services, and user experience.
• Complying with legal obligations and regulatory requirements.

3. KYC Data Handling

KYC documents are treated with the highest level of sensitivity. Specifically:

• Documents are encrypted at rest using AES-256 encryption.
• Access to KYC documents is restricted to authorized admin personnel only.
• Documents are reviewed during the registration process and then archived securely.
• KYC data is never shared with carriers, third parties, or used for marketing purposes.
• You may request deletion of your KYC data after account closure, subject to legal retention requirements.

We implement industry-standard security measures to protect your data:

• All data in transit is encrypted using TLS 1.3.
• Passwords are hashed using bcrypt and are never stored in plain text.
• Our infrastructure is hosted on secure, access-controlled servers.

We do not sell, trade, or rent your personal information to third parties. We may share limited data in the following circumstances:

• Carriers: Only the minimum information necessary (number, LoA, carrier details) to process port requests.
• Payment Processors: Transaction-related data required to process payments via PayPal or cryptocurrency gateways.
• Legal Requirements: When required by law, regulation, or valid legal process.

7. Data Retention

1. Acceptance of Terms

By creating an account or using Portway ("the Service"), operated by Jianzing ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including approved account holders and visitors.

2. Description of Services

Portway provides the following services:

• Full Number Porting: Facilitation of wireless and landline number ports between carriers.
• Hosted SMS Forwarding: Enabling SMS/MMS forwarding on voice-enabled numbers without full porting.
• Number Purchase: Procurement of new phone numbers through supported carriers.

We act as an intermediary between you and carriers. Port completion times, carrier fees, and carrier policies are subject to the respective carrier's terms and are beyond our direct control.

3. Account Registration & KYC

To use the Service, you must:

• Be at least 18 years of age.
• Provide accurate and complete registration information.
• Submit required KYC documents: a recent account statement, a recent utility bill, and a government-issued photo ID (front and back).
• Maintain the accuracy of your information and notify us of any changes.

Submission of false or misleading information will result in immediate denial or termination of your account without refund.

4. Registration & Payment

After your KYC documents are reviewed and approved by our admin team, you will receive a registration invoice via email. This invoice will contain:

• A non-refundable registration fee of $80.00 USD.
• Available credit package options (100, 250, 500, and 1000 credits) and their respective prices.
• Service costs: Full Port Request (100 credits), Hosted SMS Setup (150 credits), Buy Number (40 credits).
• A secure payment link supporting PayPal and cryptocurrency payments (Bitcoin, Ethereum, USDT TRC-20).

5. Credits System

Services are billed using a credits system where 1 credit equals $1.00 USD in value. Detailed credit costs and package options are provided in your registration invoice. Key rules:

• Credits are purchased in packages and added to your account balance.
• Credits are deducted when you place service requests (port, hosted SMS, number purchase).
• Credits do not expire while your account remains active.
• Credits are non-transferable and may not be exchanged for cash.
• If a service request fails due to carrier rejection and no work was performed, credits may be refunded to your balance at our sole discretion.

6. Prohibited Uses

You may not use the Service to:

• Port numbers you do not own or are not authorized to port.
• Submit fraudulent, misleading, or falsified documents or information.
• Use the Service for any illegal, fraudulent, or harmful activity.
• Attempt to circumvent security measures, access other users' accounts, or disrupt the platform.
• Resell or redistribute the Service without our written consent.
• Use hosted SMS for spam, harassment, or unsolicited communications.
• Violate any applicable laws, regulations, or third-party rights.

7. Service Availability & Carrier Dependencies

The Service depends on third-party carriers (Telnyx, Sinch, Twilio, Bandwidth, etc.). We strive for high availability but cannot guarantee uninterrupted service. Specifically:

• Port completion times are estimates and vary by carrier (typically 3-5 business days but may take longer).
• Carriers may reject port requests for reasons beyond our control.
• Carrier outages, API changes, or policy updates may temporarily affect service availability.
• We are not liable for delays or failures caused by carriers.

8. Letter of Authorization (LoA)

By using porting services, you authorize us to generate and submit Letters of Authorization on your behalf to the relevant carrier. The LoA contains your name, phone number, and carrier account information necessary to process the port. You are responsible for ensuring all information in the LoA is accurate.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
• We are not liable for loss of phone service during or after the porting process.
• We are not liable for carrier fees, charges, or penalties imposed by your current or receiving carrier.

10. Indemnification

You agree to indemnify, defend, and hold harmless Jianzing, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) fraudulent or unauthorized porting of numbers.

11. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including but not limited to:

• Violation of these Terms.
• Suspicious or fraudulent activity.
• Failure to pay required fees.
• Request by law enforcement or regulatory authority.

Upon termination, any remaining credits in your account are forfeited. KYC documents will be retained in accordance with our Privacy Policy and applicable regulations.

12. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable rules. You waive any right to participate in class-action lawsuits or class-wide arbitration.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Jianzing is registered, without regard to conflict of law principles.

14. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
